Probate Estates

Should you and your family lose a loved one who has left assets, such as real estate, bank accounts, 401 k plans, IRA's and automobiles.

And the assets are only in their name of that loved one, with no named beneficiary, then that decedent's estate must be submitted to the Massachusetts Probate and Family Court so the rightful heirs can receive the assets.

If the departed has a will then a petition must be filed with the Probate and Family Court to allow the will and distribute the decedent's assets according to their wishes.

Should your loved one die without a will, which is known as dying intestate, then a petition to appoint an administrator of the Estate must be filed with the Probate and Family Court and their assets will be distributed according to the Massachusetts laws of intestacy.
